What is the work to be completed?

You need to understand the full scope of any remodeling project and know what specific role you’ll be playing to make the job a success.
This information can sometimes be hard to obtain from clients as they may be withholding from you, or they don’t have much experience with remodeling jobs.
Below are some questions you can ask to get a specific understanding of the job so you can outline the essential responsibilities and milestones in your remodeling contract.

  • • Have you been through a remodeling job in the past? If so, how was your experience?
  • • What are your top two concerns about the job?
  • • Who is the main point of contact for the project?
  • • Will I be working with other contractors? If so, how many?
  • • What is the expected timeframe for the job?
  • • If there are changes to the project, am I expected to be available to address them?
Use a combination of the questions above to get a concrete understanding of the remodeling job at hand and ultimately decide if it’s worth you putting pen to paper on a contract.

What is the process for changes?

No matter how much planning clients do upfront, sometimes, you can’t prevent unforeseen circumstances. Perhaps the client runs out of money, or terrible weather prevents any progress, or the aesthetic of the remodel is not what was expected.
Whatever the reason may be, changes happen, and they happen all the time.
But as a professional tradesperson, constant project amendments can cost you time, money, and frustration. To mitigate this risk, work with all parties upfront about a process for dealing with changes.
For example, if a client requests a change that is outside the scope of the original contract, you as the contractor are required to draw up another remodeling agreement to reflect the changes. No work can proceed until all parties sign off on the amended contract.
Having a robust revision process in place protects the contractor from doing extra work, and also holds the client accountable to really think through their requests.
That way, everyone is on the same page about the trade-offs of contract amendments.

The performances and obligations of both Parties are not to violate the rights of any third party or else violate other, if any, agreements made between them and/or any other organization, person, business or law/governmental regulation.

Disclaimer Of Warranties

– The Contractor warrants to complete the Services listed in this Agreement as per the Client’s requirements and specifications. However, the Contractor does not represent or warrant that such services provided in this Agreement will create additional sales, exposure, brand recognition, profits or other similar benefits.
– In addition to the above, the Contractor holds no responsibility towards the Client in the event that the delivered work doesn’t lead to the Client’s desired results.

Limitation Of Liability

– Under no circumstances will either Party be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of or relating to this Agreement or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) in the event that such is not related to the direct result of one of the Parties’ negligence or breach.

Severability

– In the event that any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, then the remaining provisions will remain in force in accordance with the Parties’ intention.
